Man sentenced to two years, DNA links crime scenes

    A man who left a trail of DNA evidence linking him to three break and enters followed that path straight into custody.     Darryl Weatherly, 46, appeared in provincial court on Friday, May 13. He pleaded guilty to a number of charges, including two counts of break and enter, break and enter and theft and obstructing a peace officer.
    The court heard how in April of 2009 the Drumheller Legion was broken into, and $4,700 was taken from the safe. The total including funds taken and damage came to $7,255.50
    Weatherly was also connected to a break and enter at an excavation company in Calgary on August 7, 2010 and a ski and snowboard shop in Calgary on August 21 of the same year. There, 74 pairs of sunglasses were taken.
    The court heard that at each of the scenes there was blood left. Investigators were able to match up the evidence and made the arrest.
    Weatherly was arrested in Drumheller in March at his mother’s home. Defence said he was aware of his arrest warrant and was planning to turn himself in the next day when he was arrested. He resisted police and tried to run away before he was apprehended.
    Weatherly has served 46 days in custody awaiting his appearance in court. He was sentenced to two years, plus a day in custody, taking into account his presentence custody. A compensation order of $7,255.50 was granted  to allow the Legion to recoup its losses through a civil matter.
