Former Corrections Officer loses bid to retain job

A former corrections supervisor at the Drumheller Institution who completed the alternative measures program to deal with charges outside the traditional court system, has lost his bid to be reinstated in his employment.

    In January of 2013, charges of possession of stolen property, possession of the proceeds of crime and theft under $5,000 were withdrawn against Nathan Shandera. The charges were related to the disappearance of two video cameras and just over $1,000 from the Drumheller Institution. One of the cameras was sold on eBay to a Quebec address and one was purchased by the Drumheller RCMP and shipped to an RCMP corporal in Calgary.

Shandera was terminated from his position by Warden Darcy Emann on January 15, 2013.

Shandera filed a grievance against Corrections Service of Canada asking that he be reinstated to his employment with damages.  At the hearing in front of the Public Service Labour Relations and Employment Board, Shandera indicated he was no longer seeking reinstatement, but instead a public apology from CSC.

The Public Service Labour Relations and Employment Board hearing was heard in Calgary from March 1-4 2016.  On March 17, 2017, it released its decision.

In its ruling, in weighing the evidence brought forward to the hearing Dave Olson of the board wrote in the decision “I am satisfied that the employer met its burden of demonstrating that on a balance of probabilities, which is the burden of civil cases, it is more likely than not that the grievor removed the two cameras without authorization from the Institution and then attempted to sell them on eBay.”

In reference to the missing $1,000, “ I conclude that the employer has established on a balance of probabilities that is more likely than not that Mr. Shandera took the cash from the vault.”

With these conclusions the board dismissed the grievance and that Warden Emann was “justified in concluding that the employment relations had been broken beyond repair by the Grievor’s action.”

 


PLRD disqualifies trustee

The Prairie Land Regional School Division Board has voted to remove one of its trustees for missing three consecutive meetings.

Chair of the board Marsha Tkach told The Mail that at their meeting on May 25, Trustees have disqualified Ward 2, Subdivision 1 Trustee Jada Hill, however, there are conditions.

“The motion reads ‘that Jada Hill be disqualified as trustee due to being absent for three consecutive meetings, as per the School Act, Section 82 (1) unless a medical certificate certifying her absence is provided to the board chair prior to June 15, 2017,’” said Marsha Tkach.

She says the motion is based on the provision of the School Act.

She said that under the School Act, a trustee cannot absence them self without being authorized by a resolution of the board, to do so from three consecutive regular meetings with the board.

The Act does allow for the absence due to an illness if the person provides evidence of that illness in the form of a medical certificate.

Tkach says that she understands that two of Hill’s absences were because she was not able to get away from work.

    The Mail reached out to Ms. Hill for comment however as of press time, she did not respond.

    Tkach said there were six trustees present at the meeting however at the time of the vote, Hill had left the meeting. The remaining five voted for the motion.

RCMP Serious Crimes South seek supect in chase, shooting

Beiseker, Alberta – Investigators from the RCMP’s southern serious crimes branch are asking for public assistance to solve a bizarre incident that led to gunshots being fired during a car chase on rural roads North East of Airdrie.

On May 28 between 7:00 pm and 9:00 pm, two men in an older model white GMC pick- up truck became lost in the rural area near Beiseker and Acme. The men were chased from the location by three men in their 20’s who were driving a red Chevrolet truck.

The men in the red truck chased the white truck through rural roads, attempting to force the white truck off the road several times by ramming the vehicle. Towards the end of the chase, the occupants of the red truck fired gunshots at the white truck, resulting in one of the occupants being shot and sustaining serious injuries. The red truck eventually stopped the chase as the vehicles approached Airdrie where the victims attended the Airdrie RCMP detachment to report what happened.

Investigators are looking for public assistance to locate the men responsible for this offence as well as the vehicle involved. The involved truck is described as a red 2007-2013 Chevrolet pick-up. There will be noticeable front end damage as a result of the ramming that took place during the chase.

RCMP also believe that two male witnesses may have seen a portion of the events in the area of Township Road 270 and Range Road 253. These men were in a blue Ford F-150 near the Tschetter Hutterite Colony East of Beiseker. Investigators are asking that these witnesses please come forward.
